PRIVACY POLICY

This privacy policy sets out how ANCI Pty Ltd (ACN 613 288 243) (“we”) treat the privacy of users of our Anci application, website, system and services (“Anci Platform”) and others with whom we interact.

In this privacy policy, the term “personal information” includes information or opinion about an identifiable individual, including names, addresses, telephone numbers, email addresses, details of professional qualifications, photographs, credit and banking details and if and where applicable, includes information that constitutes “sensitive information” under the Privacy Act 1988 (Cth).

Personal information also includes opinions about identifiable individuals, including opinions about the quality of the services that they provide or their characteristics as a customer/ consumer.

1. COLLECTION AND STORAGE OF PERSONAL INFORMATION

We collect some personal information from users, such as names, email addresses, and phone contact details.  Given the nature of the Anci Platform, we may also collect opinions about identifiable individuals.

We may collect and store personal information in circumstances including:

(a)    When a person applies or registers to become a customer of or service provider for the Anci Platform;
(b)    When a user posts content revealing their identity or the identity of another person on the Anci Platform;
(c)    When a user sends an enquiry through or makes a comment through our website, through an email or via a social media platform;
(d)    When a user signs up to an email marketing list;
(e)    When we meet with an organisation wishing to do business with us (and an individual from that organisation provides details), or when a person requests a demonstration of the Anci Platform and provides their details for that purpose; and
(f)    When a person enters into a transaction with us using a credit card.

When evaluating potential service providers, we may conduct police checks.

If you provide personal information to us about someone other than yourself, you must ensure that you are entitled to disclose that information to us and that we may collect, use and disclose such information for the purposes described in this Privacy Policy.

2. COOKIES

We may use or engage other service providers who use ‘cookies’ to collect data (typically not personal information) relating to your general usage of the Anci Platform.  This data may include IP-addresses, geographic location, browser versions, number of visits and similar such data relating to your navigation of our Anci Platform and linked Anci Platforms and online stores.  Cookies help us to improve and deliver a better and more tailored service.

You may refuse to accept cookies by activating settings on your device.  However, please note that if you select such settings you may be unable to access certain features of our Anci Platform.

3. USE AND DISCLOSURE OF PERSONAL INFORMATION

If an individual user provides personal information it may be provided to others with whom they consent to be connected through the use of the Anci Platform (such as between a service provider and customer) to the extent necessary to facilitate that relationship.

We use the personal information collected from you for the purpose it was provided or collected, including in the following ways:

(a)    For use for the purposes of collection described in (1) above;
(b)    To enable a person to use the Anci Platform;
(c)    If and when that information is included in feedback from a user, customer or service provider;
(d)    If the information is about an individual who is a feedback subject, by making it available to the feedback subject;
(e)    To respond to enquiries received from you;
(f)    To perform authorised financial transactions with you;
(g)    To verify your identity and to assist you if you have forgotten any user ID, user name or password;
(h)    To communicate with you and provide you with information (whether by email, post or other means) about our products or Anci Platform (including to notify you of changes to the Anci Platform), where you have requested or consented to receiving this from us or where this provision is otherwise permitted under the Australian Privacy Principles or other applicable law;
(i)    To allow you to participate in interactive features of our Anci Platform when you choose to do so;
(j)    To receive and address feedback or complaints about us or our service from you;
(k)    To protect our legal interests and fulfill our regulatory obligations (if and to the extent necessary);
(l)    To respond to allegations of abuse of the Anci Platform; and
(m)    In other circumstances, with the relevant individual’s prior consent.

We may use personal information for the purpose of marketing to users but only where such use complies with applicable legislation.

All users and others with whom we interact have the option to opt-out of receiving marketing communications from us.  If you do not wish to continue to receive electronic marketing communications from us and/or selected third parties you should opt-out by clicking on the “unsubscribe” link in any email communications that we might send you.

We may disclose your personal information:

(a)    to third parties we contract specialised functions to, and to Service Providers for the purposes of providing services to you as a customer in accordance with the Anci Platform.  If we do disclose personal information to third party contractors we take steps to ensure that those contractors and Service Providers comply with the Australian Privacy Principles when they handle your personal information;
(a)    Where we have your express permission to do so;
(b)    Where it can reasonably be inferred from the circumstances that you consent to the disclosure to the third parties;
(c)    If Anci Pty Ltd or substantially all of its assets or its business are acquired by a third party, in which case personal information which we hold about our customers, service providers and users may be one of the transferred assets (subject to the same constraints on use and disclosure as under this policy); and
(d)    If we are under a duty to disclose or share your personal information in order to comply with any legal obligation, or in order to enforce or apply our terms and conditions or to protect the rights, property, or the safety of Anci Pty Ltd, its personnel, service providers or customers . This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

We would only use or disclose the type and amount of information necessary to carry out the relevant purpose.  For example, we would not need to use or disclose opinions about individuals for many of these purposes but simply basic information such as name or email address.

We limit the information we provide to third parties to the information they need to help us provide or facilitate the provision of goods and services to you.  We deal with third parties that are required to meet the privacy standards required by law in handling your personal information, and use your personal information only for the purposes that we gave it to them.

4. DISCLOSURE AND TRANSFER OF INFORMATION OVERSEAS

We do not disclose or transfer personal information outside Australia.

5. SECURITY OF PERSONAL INFORMATION

We hold personal information in our own secure databases.

We take all reasonable steps to protect your personal information, including by internal and external security and restricting access within the organisation to personal information to those who have a need to know.  We implement and maintain technological products to prevent unauthorised computer access and regularly review our technology to maintain security.

We treat website and credit card security seriously and endeavour to provide a secure, safe platform through which to conduct transactions (if any).

6. QUESTIONS AND CONCERNS AND ACCESS TO/ CORRECTION OR UPDATING OF YOUR PERSONAL INFORMATION

It is important that the personal information we hold about you remains accurate and up to date.  If you consider that personal information we have about you is not accurate, complete or is outdated, please contact us with your request for correction.  We will promptly consider any requests for correction.

7. CHANGES TO OUR PRIVACY POLICY
